2. Grant of License
2.1. License. The Developer hereby grants You a limited, worldwide, non-exclusive, non-transferable license to use the Plugin (including any generally available updates and upgrades released during Your rightful use of the Plugin) as long as the use is in line with Your Confirmation, the Documentation, and the limits set out in this EULA. You may:
- install the Plugin;
- use the Plugin subject to the limits described in Your Confirmation (if any); and
- make backup copies of the Plugin for archival purposes.
2.2. Restrictions. Except as permitted by the Apache License, Version 2.0 for the Source Code (Section 5) or by applicable law, You may not:
- remove, disable or circumvent the license verification of a Plugin obtained through JetBrains Marketplace, or use its Paid Features without a valid license or trial;
- allow more Plugin Users to use the Paid Features than Your Confirmation allows; or
- sublicense, resell, rent or share a license bought for Paid Features.
Nothing in this EULA restricts any act that applicable law allows regardless of a contract, such as making a backup copy, or observing, studying or testing how the Plugin works, or decompiling it where that is necessary for interoperability.
2.3. Duration of License. The license granted under this EULA can be provided as:
- perpetual in case of Free Plugins, Free Features or Paid Plugins for which You are charged a one-time license fee, and
- time-limited for the duration of Your Subscription Period, in case of Paid Plugins for which You pay an annual or monthly Subscription fee.
For more details about the type of Paid Plugin, see the information in Your Confirmation.
2.4. Free Features. You may use the Free Features of a Plugin without a paid license, for any lawful purpose, including commercial use, on any number of devices.
2.5. Purchases. JetBrains sells the licenses for Paid Features and handles payments, invoices, refunds and withdrawal under its own terms of purchase. The Developer does not charge You directly.
3. Subscription
3.1. Subscription Limits. If You purchased a Plugin Subscription, You must use the Paid Plugin in accordance with the limits described in Your subscription plan (e.g., You must ensure that the maximum number of Plugin Users does not exceed the number of Plugin Users for which You have purchased the Subscription).
3.2. Subscription Period. The Subscription Period can be either annual or monthly.
3.3. Fallback License. If the Plugin is provided with a Fallback license according to the Confirmation, following the expiration of the Subscription Period without a renewal, Your license to use the Plugin as stipulated in Section 2 shall continue on a perpetual, royalty-free, non-exclusive, and non-transferable basis with respect to the Fallback Version of the Plugin (including all limitations). The granting of the Fallback license is expressly contingent upon Your compliance with this EULA, including Your payment of the applicable Subscription fees for at least the preceding 12 months in full and without interruptions.
4. Intellectual Property
The Plugin is protected by copyright and other intellectual property laws and treaties. The Developer or its licensors own all title, copyright, and other intellectual property rights to the Plugin.
5. Source Code and open-source components
5.1. The Source Code is licensed under the Apache License, Version 2.0, which is a separate license. Nothing in this EULA limits, conditions or revokes any right You have under that license with respect to the Source Code or any work You build from it.
5.2. This EULA governs the use of the Plugins distributed through JetBrains Marketplace, the paid license for their Paid Features, and the warranty, liability and support terms that apply to them.
5.3. The Plugins include third-party open-source components. Each component is licensed under its own terms, which prevail over this EULA for that component.
6. Disclaimer of Warranty
6.1. ALL PLUGINS ARE PROVIDED TO YOU ON AN "AS-IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES. YOUR USE OF PLUGINS IS AT YOUR OWN RISK. THE DEVELOPER PROVIDES NO WARRANTY AS TO THE PLUGIN'S USE OR PERFORMANCE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, WITH REGARD TO THE PLUGIN, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES. THE DEVELOPER DOES NOT WARRANT THAT THE PLUGIN IS ACCURATE, RELIABLE, OR CORRECT; THAT THE PLUGIN MEETS YOUR REQUIREMENTS; THAT THE PLUGIN WILL BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION, UNINTERRUPTED, OR SECURE; THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED; OR THAT THE PLUGIN IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. EXCEPT AS REQUIRED BY APPLICABLE LAWS, ANY UPDATES AND UPGRADES TO THE PLUGIN WILL ONLY BE PROVIDED ON AN "AS AVAILABLE" BASIS, I.E., AT THE DEVELOPER'S SOLE DISCRETION.
6.2. Consumers. If You are a Consumer, Section 6.1 does not affect the warranties and guarantees of conformity that the law of Your country gives You and that cannot be excluded by contract.
6.3. Consumers in Colombia. For Consumers in Colombia, the legal warranty of Law 1480 of 2011 applies to the Paid Features for one (1) year from the purchase or renewal of the license. If the Paid Features do not work as described in the Documentation, You may choose between the correction of the defect and the refund of the price paid for the affected period. To use this warranty, write to gaphunterlabs@gmail.com. A refund is processed through JetBrains.
7. Limitation of Liability
7.1. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR CONSEQUENTIAL DAMAGES, NO MATTER THE CAUSE OF SAID PROFITS OR DAMAGES, AND IN NO EVENT WILL THE DEVELOPER'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE USE OF THE PLUGIN EXCEED THE GREATER OF (A) THE FEES WHICH YOU PAID FOR THE PLUGIN VIA JETBRAINS MARKETPLACE IN THE TWELVE-MONTH PERIOD PRECEDING THE CLAIM, AND (B) ONE HUNDRED US DOLLARS (USD 100). THIS LIMITATION WILL APPLY EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF THE LIABILITY EXCEEDING THE AMOUNT AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY.
7.2. Section 7.1 does not limit or exclude liability for fraud or wilful misconduct, gross negligence, death or personal injury, or any other liability that cannot be limited or excluded under applicable law, including the mandatory rights of Consumers.
7.3. JETBRAINS' LIABILITY IS EXCLUDED IN ITS ENTIRETY AS JETBRAINS IS NOT A PARTY TO THE CONTRACTUAL RELATIONSHIP BETWEEN THE DEVELOPER AND YOU.
8. Support and security updates
8.1. The Developer provides support for the Paid Features by email at gaphunterlabs@gmail.com and through each Plugin's GitHub issue tracker, during normal business hours in Colombia, and uses commercially reasonable efforts to respond within two (2) business days to requests that JetBrains identifies as critical and within five (5) business days to all other requests.
8.2. The Developer releases fixes for security vulnerabilities for the latest version of each Plugin published on JetBrains Marketplace, at least until 31 December 2031. Report suspected vulnerabilities privately, as described in the SECURITY.md file of each Plugin's repository.
8.3. If You are a Consumer, the Developer supplies the updates needed to keep the Plugin in conformity with this EULA for as long as applicable law requires, including throughout Your Subscription Period.
9. Privacy
Each Plugin's privacy notice (the PRIVACY.md file in its repository at https://github.com/GapHunterLabs) describes what the Plugin stores and whether it connects to any service.
10. Changes to this EULA
The Developer may publish new versions of this EULA at the address shown at the top of this document and will announce material changes at least thirty (30) days before they take effect. A new version applies to You only from the start of Your next Subscription Period, or for a Plugin version released after its effective date. It never applies retroactively.
11. Governing law
This EULA is governed by the laws of the Republic of Colombia, excluding its conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If You are a Consumer, You keep the protection of the mandatory law of the country where You habitually reside, and nothing in this EULA limits Your right to bring proceedings there.
12. Language
This EULA is provided in English and in Spanish. For Consumers in Colombia, the Spanish version prevails. In every other case, the English version prevails if the two versions differ.
13. Contact and version
